1. Agreement to Terms
By accessing or using the GuestAI platform at guestai.chat (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you ("User", "Host", "you") and GuestAI ("we", "our", "us").
2. Service Description
GuestAI is an AI-powered guest communication platform for vacation rental hosts and property managers. The Service provides:
- AI chatbot that answers guest questions via WhatsApp, Viber, and email
- Property knowledge base management (text, documents, photos)
- Automated message scheduling and templates
- Guest management and booking platform integrations
- AI usage analytics and billing management
3. Account Registration
- You must be at least 18 years old to create an account.
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized access to your account.
- One person or entity may maintain only one account.
4. Subscription & Billing
4.1 Plans & Pricing
The Service is offered through subscription plans with different tiers. Current pricing is available on our website. We reserve the right to modify pricing with 30 days' notice.
4.2 Free Trial
New accounts receive a free trial period. No payment information is required during the trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service.
4.3 Billing
- Subscriptions are billed monthly or annually, depending on your chosen plan.
- Payments are processed securely through Stripe.
- Messages exceeding your plan's included quota are billed at the overage rate.
- You may set a monthly budget cap to control costs.
4.4 Cancellation & Refunds
- You may cancel your subscription at any time from your billing settings.
- Cancellation takes effect at the end of the current billing period.
- No refunds are provided for partial billing periods.
- Upon cancellation, your data is retained for 30 days, after which it may be deleted.
5. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Upload content that is defamatory, obscene, fraudulent, or infringes on third-party rights.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Use the Service to send unsolicited messages (spam) to guests or third parties.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the AI features to generate harmful, misleading, or deceptive content.
- Resell, sublicense, or redistribute the Service without written consent.
- Exceed rate limits or abuse API endpoints.
6. Your Content & Data
6.1 Ownership
You retain all rights to the content you upload to the Service (property information, photos, documents, guest data). We do not claim ownership of your content.
6.2 License
By uploading content, you grant us a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the Service. This includes sending content to AI providers for processing and to messaging platforms for delivery.
6.3 Guest Data Responsibility
As a host, you are the data controller for guest personal data you input into the Service. You are responsible for:
- Having a lawful basis to process guest data (typically contract performance for bookings).
- Informing guests that an AI assistant may respond to their messages.
- Handling guest data requests (access, deletion) in accordance with GDPR.
7. AI-Generated Content Disclaimer
The Service uses artificial intelligence to generate responses to guest inquiries. While we strive for accuracy, AI-generated responses may occasionally contain errors, inaccuracies, or outdated information.
- You are responsible for ensuring the accuracy of your property knowledge base.
- We recommend reviewing AI responses periodically through the inbox.
- The AI will escalate complex or sensitive requests to you as the host.
- We are not liable for any damages arising from inaccurate AI-generated responses.
- The AI is not a substitute for emergency services, legal advice, or medical guidance.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:
- Scheduled maintenance (with reasonable advance notice).
- Third-party service disruptions (WhatsApp, OpenAI, Twilio, etc.).
- Force majeure events beyond our control.
We are not liable for any losses resulting from service downtime or message delivery failures caused by third-party platforms.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUESTAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BOOKINGS, REPUTATION, OR BUSINESS OPPORTUNITIES.
Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless GuestAI from any claims, damages, or expenses (including legal fees) arising from:
- Your use of the Service in violation of these Terms.
- Content you upload that infringes third-party rights.
- Your failure to comply with applicable data protection laws regarding guest data.
11. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by GuestAI and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without written permission.
12. Termination
- You may terminate your account at any time by contacting us or through the billing settings.
- We may suspend or terminate your account if you violate these Terms, with notice where possible.
- Upon termination, your right to use the Service ceases immediately.
- We will retain your data for 30 days post-termination to allow data export, then delete it.
13. Governing Law & Disputes
These Terms are governed by the laws of Greece. Any disputes arising from these Terms or the Service shall be resolved by the competent courts of Thessaloniki, Greece.
For EU consumers: You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
